Premium Parking Terms and Conditions

These Terms and Conditions apply to your use of the Premium Parking services at the Trafford Centre, including any Bookings and payments made through the Website and in person at the Premium Car Park. As these Terms and Conditions form the basis of the contract made between us when we confirm your Booking, it is important that you read and retain a copy of these Terms and Conditions prior to making your Booking. By purchasing or using the Services you acknowledge and agree that you have read these Terms and Conditions and that your Booking is subject to these Terms and Conditions.

  • Definitions
    • “Booking” refers to the reservation made by you for the Services either in advance via the Website or in person at the Premium Car Park.
    • “Premium Car Park” refers to the premium car park operated by us at the Premium Car Park, Upper Peel 5 Car Park, Peel Circle, Trafford Centre, Manchester M17 8AX.
    • “Services” refers to the hourly premium car parking, valet parking and valeting / cleaning and any otherservices provided by us the Premium Car Park.
    • “Terms and Conditions” refers to these terms and conditions, as forming the basis of the contract between us and you for any Booking, governing the provision of Services to you and governing your use of the Premium Car Park and Services.
    • “Vehicle” refers to the car or other roadworthy vehicle that you bring to the Premium Car Park for the Services.
    • “We,” “us,” or “our” refers to Premium Parking Manchester Limited, Company Number 15754800) whose registered office is 71 Halesowen Road, Netherton, Dudley DY2 9PJ. Whose trading address is Premium Car Park Services Office, Upper Peel Car Park 5, Access Road, Trafford Centre, Manchester, M17 8AX.
    • “Website” refers to the website at https://traffordcentre.co.uk/premiumparking, through which you can make Bookings.
    • “You” or “your” refers to you, being the customer accessing and using the Services.
  • Booking and payment
    • Bookings can be made in advance through the Website, or in person by paying on or prior to exit of the Premium Car Park. Please note that we cannot guarantee any availability of our Services for Bookings made on arrival. Your Booking is confirmed, and the contract between us is formed and commences, when:
      • in the case of Bookings made through the Website, we accept your Booking by sending you a booking confirmation via email; or
      • in the case of Bookings made in person at the Premium Car Park, you enter the Premium Car Park and there is capacity to provide you with the Services you select.
    • The contract between us ends after you have left the Premium Car Park or your Booking and any Services have been completed or cancelled in accordance with the terms of these Terms and Conditions.
    • For Bookings made via the Website full payment is required at the time the Booking is made. For Bookings made on arrival, full payment is required prior to you exiting the Premium Car Park. The payment methods we accept shall be listed on the Website and visible prior to completing any Booking.
    • The prices for our Services are as displayed on the Website and at the Premium Car Park at the time the Booking is made and are inclusive of VAT, where applicable. We reserve the right to amend the prices for any of our Services at any time prior to us confirming your Booking in accordance with clause 2.1.
  • Cancellation
    • In the case of Bookings made through the Website you may cancel your Booking up to 48 hours before the scheduled time of arrival and receive a refund of the amount paid by you in relation to such Booking, provided that a refund request is sent to contact@tcpremiumparking.co.uk more than 48 hours before your Booking’s scheduled time of arrival, which clearly confirms all of your Booking details (including your Vehicle’s registration number, Booking reference number, schedule time and date of arrival of your Booking, Services selected, the price paid and the date the Booking was made).
    • Cancellations made less than 48 hours before the scheduled time of arrival shall not be eligible for a refund of the amount paid by you in relation to such Booking.
    • We may cancel your Booking at any time on notice to you if:
      • you breach these Terms and Conditions;
      • we suspect that you have misused or will misuse your Booking;
      • the Premium Car Park is no longer available or we are unable to provide the Services to you at the time and/or in the manner specified in your Booking; or
      • The Trafford Centre, its roadways and/or its car parks are closed.
    • In the event we cancel your Booking in accordance with clause 3.3.3 & 3.3.4, we will issue you with a full refund of the amount paid by you in relation to such Booking.
    • Any refunds we make in accordance with this clause 3 shall only be made to the payment method used when paying for the Booking. We shall process any refunds under clause 3 within 15 working days of us confirming that your cancellation request is valid.
  • Your use of the Services
    • You must comply with all signs and instructions displayed or given at the Premium Car Park and when using the Services. When entering and leaving the Premium Car Park you must also comply with the Trafford Centre Limited’s terms of service, which can be found at https://traffordcentre.co.uk/the-fine-print.
    • You must park your Vehicle within the marked bays and adhere to any speed limits and traffic management systems in place at the Premium Car Park.
    • Vehicles are parked at the Premium Car Park at your own risk. We do not accept liability for any accidents, damage, loss or theft to any Vehicle or any personal items or valuables left at the Premium Car Park or whilst using the Services unless it is caused by our negligence.
    • You must ensure that all personal items and valuables are removed from your Vehicle prior to the provision of any valeting services provided by us. We do not accept liability for any loss or damage to personal items or valuables left in your Vehicle during any valeting services provided by us.
    • You must ensure that your Vehicle is roadworthy, meets all necessary legal requirements and has valid insurance, tax, and MOT (if applicable) when using our Services and the Premium Car Park.
    • You must also conduct yourself in a manner that does not cause disruption or damage to the Premium Car Park or other users of the Services and their vehicles.
    • Notwithstanding the remainder of this clause 4, you shall not do anything that:
      • that damages, or is likely to damage, the property of us or a third party (including the Trafford Centre Limited); or
      • constitutes a criminal offence under the laws of England and Wales.
  • Liability
    • We will use reasonable care and skill when providing the Services to you.
    • Nothing in these Terms and Conditions limits or excludes our liability for:
      • death or personal injury caused by negligence;
      • fraud or fraudulent misrepresentation; or
      • any other liability which cannot be limited or excluded by applicable law.
    • Subject to clause 5.1, both our total liability and The Trafford Centre Limited’s total liability to you in respect of all other losses arising under or in connection with the Services, whether in contract, tort, negligence, breach of statutory duty, or otherwise, shall, to the maximum extent permitted by applicable law, be limited to the fee paid by you to us for your booking.
  • Data protection
    • We shall store, process and use your personal data in accordance with applicable data protection laws, including but not limited to the UK GDPR, the Data Protection Act 2018.

  • Severance
    • If any provision of these Terms and Conditions is found to be illegal, invalid or unenforceable, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal or enforceable.
    • If such modification is not possible, the relevant term shall, insofar as it is severable from the remaining terms, be deemed deleted from these Terms and Conditions. 
    • Any modification or deletion under this clause 7 shall in no way affect the legality, validity or enforceability of the remaining provisions of these Terms and Conditions.
  • Third party rights
    • Save as expressly set out in these Terms and Conditions, no one other than us or you (being the parties to these Terms and Conditions) shall have any right to enforce any of the terms of the Terms and Conditions or the contract between us and you and nothing in these Terms and Conditions gives rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
  • Waiver
    • Any failure or delay by us to enforce or exercise at any time or for any period of time any provision of, or any right pursuant to, these Terms and Conditions or by law does not constitute, and shall not be construed as, a waiver of such term or right and shall in no way affect our right later to enforce or to exercise it or any other term or right.
  • Transferring your Booking
    • Any Booking you make is personal to you and you are not entitled to assign, charge, sub-contract or transfer the contract we have with you or any part of it (including but not limited to the Services) without our prior written consent.
    • We may assign, charge, sub-contract or transfer the contract we have with you or any part of it to any person.
  • Governing law and jurisdiction
    • These Terms and Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Terms and Conditions, their subject matter or formation are governed by and construed in accordance with the laws of England and Wales.
    • To the maximum extent permissible by law, any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions, their subject matter or formation shall be subject to the exclusive jurisdiction of the courts of England and Wales.
    • Notwithstanding the foregoing, you may have rights as a consumer to bring a dispute or claim in the courts of the country in which you are domiciled.

  • Changes to these Terms and Conditions
    • The Terms and Conditions that apply to your Booking are those in place when you paid for your Booking. We may introduce new versions of these Terms and Conditions from time to time applying to future Bookings.
